Divorce in Australia: Things to Be Aware Of
- A copy of your marriage certificate;
- You must have been separated for at least for 12 months and 1 day (evidence may be required if there is a dispute);
- Your marriage must have broken down, with no reasonable likelihood that you will get back together; and
- You must be an Australian resident, or citizen, or regard Australia as your permanent home.

If you have children under the age of 18, before granting a divorce the Court needs to be satisfied that you have an agreement in place for your children’s welfare, covering matters such as:
