Divorce in Australia: Things to Be Aware Of

 

Once your divorce has been finalised, you have one year from the date of divorce to resolve your property settlement issues or you may lose your right to file a claim in Court to pursue a resolution. 

For De Facto relationships, you have two years from the date of separation to resolve your property settlement issues or you may lose your right to file a claim in Court to pursue a resolution

Divorce in Australia: Things to Be Aware Of

 

  • A photocopy of your marriage certificate;
  • You must have been separated for at least for 12 months and 1 day (evidence may be required if there is a dispute);
  • You need to have been married for at least 2 years;
  • Your marriage must have broken down, with no reasonable likelihood that you will get back together; and
  • You must be an Australian resident, or citizen, or regard Australia as your permanent home.

If you can satisfy all of the above and you make a Joint Application with your spouse (whether or not there are children under the age of 18), you do not have to attend court to obtain your divorce.

Divorce and Child Welfare

 

If you have children under the age of 18, before granting a divorce the Court needs to be satisfied that you have an agreement in place for your children’s welfare, covering matters such as:

  • schooling;
  • parenting arrangements; 
  • child support; and 
  • medical issues. 

This can be an informal agreement, but due consideration needs to be made as part of the divorce process.
